By accessing or using Olera Health's healthcare practice management platform at olera-health.com (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service.
2. Description of Service
Olera Health provides a platform that connects healthcare practitioners with their patients. The Service includes appointment scheduling, secure messaging, session note management, treatment plan tracking, Google Calendar integration, and AI-powered chatbot assistance.
Olera Health is a technology platform and does not provide medical advice, diagnosis, or treatment. The Service facilitates communication between practitioners and patients but does not replace professional medical judgment.
3. User Accounts
Registration: To use the Service, you must create an account by providing accurate and complete information. You are responsible for maintaining the confidentiality of your account credentials.
Account Types: The Service supports two account types: Patient accounts and Practitioner accounts. Each account type has different features and permissions appropriate to its role.
Account Security: You are responsible for all activity that occurs under your account. You must notify us immediately of any unauthorized use of your account or any other breach of security.
4. Practitioner Responsibilities
Practitioners using the Service agree to:
- Maintain valid professional licenses and credentials as required by applicable law
- Use the Service in compliance with all applicable healthcare regulations
- Ensure that session notes and treatment plans are accurate and up to date
- Protect patient confidentiality in accordance with applicable privacy laws
- Not use the Service as a substitute for proper medical record-keeping systems where required by law
5. Patient Responsibilities
Patients using the Service agree to:
- Provide accurate health information to their practitioners
- Use the messaging system responsibly and not for medical emergencies
- Attend scheduled appointments or cancel with reasonable notice
- Not share account credentials with third parties
6. Google Calendar Integration
The Service offers optional integration with Google Calendar to help manage appointment scheduling. By connecting your Google Calendar:
- You authorize us to read and write calendar events on your behalf for the purpose of appointment management
- You can revoke this access at any time through your Google Account settings or through the Olera Health calendar settings
- Our use of Google Calendar data is governed by our Privacy Policy and the Google API Services User Data Policy
7. AI Chatbot
The Service includes an AI-powered chatbot to assist with scheduling, general health queries, and platform navigation. The chatbot is not a medical professional and its responses should not be considered medical advice. Always consult with your healthcare practitioner for medical decisions.
8. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose
- Attempt to gain unauthorized access to any part of the Service
- Interfere with or disrupt the Service or its infrastructure
- Upload malicious code, viruses, or harmful content
- Impersonate another person or entity
- Use the Service to send spam or unsolicited communications
- Scrape, data mine, or extract data from the Service without authorization
9. Intellectual Property
The Service, including its design, features, and content (excluding user-generated content), is owned by Olera Health and protected by intellectual property laws. You may not copy, modify, distribute, or reverse-engineer any part of the Service without our written permission.
You retain ownership of all content you submit through the Service (session notes, messages, profile information). By using the Service, you grant us a limited license to store and process your content solely for the purpose of providing the Service.
10. Limitation of Liability
To the maximum extent permitted by law, Olera Health shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, or interruption of service, arising out of or related to your use of the Service.
Olera Health is not responsible for the accuracy or quality of medical care provided by practitioners through the platform. The practitioner-patient relationship is solely between the practitioner and patient.
11. Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
12. Termination
We may suspend or terminate your access to the Service at any time for violation of these Terms or for any other reason at our discretion. You may delete your account at any time by contacting us. Upon termination, your right to use the Service ceases immediately, and we will handle your data in accordance with our Privacy Policy.
13. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify users of material changes by posting the updated Terms on this page and updating the "Last updated" date. Continued use of the Service after changes constitutes acceptance of the modified Terms.
14. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles.
